MIMIC Evaluation Program

1. Evaluator Obligations

   The purpose of the evaluation period is for the evaluator to determine whether to purchase a license for MIMIC.

   • The evaluator agrees to conduct a good faith evaluation of MIMIC and agrees to abide by all the terms of the License Agreement accompanying the product.
   • The evaluator or the evaluator's company has NO obligation under this program to purchase or otherwise acquire any service or item from Gambit Communications, Inc.
   • The evaluator will use one copy of the evaluation on the licensed computer and will make no additional copies except for archival purposes, if necessary.

2. Export Controls

   MIMIC and its underlying information and technology cannot be downloaded or otherwise exported or re-exported into (or to a national or resident of) Cuba, Iraq, Libya, Sudan, North Korea, Iran, Syria, or any other country to which the United States has embargoed goods; or to anyone on the United States Treasury Department's list of Specially Designated Nationals or the United States Commerce Department's Table of Denial Orders. By downloading or using the software, you are agreeing to the foregoing, and you are representing and warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list. In addition, you are responsible for complying with any local laws in your jurisdiction which may impact your right to import, export or use MIMIC.

3. Evaluation Period

   The MIMIC evaluation has a time-out period built into the software from the date of issuance of license keys. When the evaluation period ends, the evaluator will destroy all copies of MIMIC and its documentation.

4. Disclaimer of Warranty

   The MIMIC evaluation is provided on an "As Is" basis, without warrany of any kind. This disclaimer of warranty constitutes an essential part of this Agreement.
